  • Justin Valentine has given a seminar to two firms of solicitors on how to successfully pursue workplace claims after the removal of civil liability for breach of health and safety regulations by the Enterprise and Regulatory Reform Act 2013. Notwithstanding the Government's insistence that the removal of civil liability for breach of health and safety regulations made under the Health and Safety at Work Act 1974 is not intended to undermine the UK's commitment to health and safety in the workplace, such claims will inevitably become more difficult to formulate.  In particular, the removal of strict liability for claims involving defective equipment places claimants at a significant evidential disadvantage.  Knowledge of these changes and how best to approach workplace claims in relation to accidents after 1st October 2013 is essential.
